Terms of use

Welcome to the Evoting Ghana platform and EG Mobile mobile applications ("Evoting Ghana," "EG Mobile," or "the Platform"). These Terms of Use ("Terms") govern your use of our event SAAS platform, which includes but is not limited to evoting for pageantry and competitions, ticketing, donation management, nomination filing, international voting, awards, competitions, General and entertainment events, ticketing, and donation processing services.

By accessing or using Evoting Ghana and EG Mobile, you agree to comply with and be bound by these Terms. If you disagree with any part of these Terms, please refrain from using our services.

1. Account Registration

1.1. To access certain features of the Platform, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process.

1.2. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

2. Use of Services

2.1. You agree to use Evoting Ghana and EG Mobile only for lawful purposes and in accordance with these Terms and any applicable laws and regulations.

2.2. You acknowledge that all content, including but not limited to text, graphics, images, audio, and video, provided on the Platform is the sole responsibility of the person or entity from whom such content originated. We do not endorse, support, represent, or guarantee the completeness, truthfulness, accuracy, or reliability of any content.

3. Intellectual Property

3.1. The Platform and its original content, features, and functionality are owned by Evoting Ghana and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

3.2. You may not modify, reproduce, distribute, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Platform, except as permitted by these Terms or with prior written consent from us.

4. User Conduct

4.1. You agree not to engage in any of the following prohibited activities:

  • Use the Platform in any way that violates any applicable law or regulation.
  • Use the Platform for any unlawful purpose or to solicit others to perform or participate in any unlawful acts.
  • Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Platform, the server on which the Platform is stored, or any server, computer, or database connected to the Platform.

5. KYC for Event Organizers/Hosts

5.1. Event organizers or hosts may be required to undergo a Know Your Customer (KYC) verification process to ensure compliance with applicable regulations and to maintain the integrity of the Platform. By using our services, you agree to cooperate with any KYC verification requests and provide accurate and up-to-date information as required.

6. Service Level Agreement (SLA)

6.1. Event organizers or hosts must accept and sign a Service Level Agreement (SLA) before using certain features of the Platform. The SLA outlines the terms and conditions governing the use of our services, including but not limited to uptime guarantees, support response times, and data security measures.

7. Limitation of Liability

7.1. In no event shall Evoting Ghana, its affiliates, officers, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses arising out of or in connection with your use of the Platform.

8. Termination

8.1. We reserve the right to terminate or suspend your account and access to the Platform at any time, without prior notice or liability, for any reason whatsoever, including but not limited to breach of these Terms.

9. Governing Law

9.1. These Terms shall be governed by and construed in accordance with the laws of Ghana, without regard to its conflict of law provisions.

10. Changes to Terms

10.1. We reserve the right to modify or replace these Terms at any time. It is your responsibility to review these Terms periodically for changes. Your continued use of the Platform following the posting of any changes to these Terms constitutes acceptance of those changes.
